Licentia Franchise SA (Pty) Ltd and all provincial Licentia entities appoint and designate Information Officers for purposes of POPIA compliance oversight, governance enforcement, and the management of data subject requests.

For the purposes of this Privacy Notice, the Information Officer functions are centralised under Licentia Head Office and apply across the Licentia Group and its provincial entities.

The Information Officer is responsible for ensuring that Licentia’s processing of personal information complies with POPIA, including lawful processing conditions, security safeguards, and the handling of data subject requests.

2.2 Deputy Information Officer (Head Office and All Provincial Entities)

The Deputy Information Officer supports the Information Officer, may act on delegated authority, and assists in operational implementation of POPIA governance standards across the Licentia Group.

2.3 POPIA Requests, Complaints, and Processing Enquiries

All requests relating to personal information may be submitted to the Information Officer or Deputy Information Officer, including requests to:

• confirm whether Licentia holds personal information about the requester;
• obtain access to records (subject to lawful limitations);
• correct or update inaccurate information;
• object to processing where applicable;
• withdraw consent where consent is the lawful basis;
• request deletion where legally permissible;
• lodge a complaint regarding suspected unlawful processing or security concerns.

Licentia may require reasonable verification of identity before releasing personal information or implementing changes, in order to prevent unauthorised disclosure.

2.4 Response Times and Internal Escalation

Licentia will acknowledge and process POPIA-related requests within a reasonable period and may escalate matters internally for review by Compliance and/or the Legal Department where:

• the request relates to regulated licensing records;
• retention obligations apply (e.g., FICA, tax, litigation hold);
• the request may affect ongoing regulatory submissions; or
• disclosure could prejudice lawful rights, enforcement actions, or pending disputes.

2.5 Legal Department Escalation (MaxMind Group)

Where a POPIA request, complaint, data incident, dispute, enforcement step, or regulatory process requires legal review, Licentia may escalate the matter to the Legal Department operated within MaxMind Group of Companies (Pty) Ltd (Registration Number: 2021/997887/07) for legal oversight, risk management, and enforcement support.

Access to relevant records by the Legal Department will occur strictly on a need-to-know basis and is subject to:

• confidentiality and legal professional secrecy;
• role-based system access controls;
• audit logging and traceability; and
• lawful retention and evidence preservation requirements.

The Legal Department is not designated as the Information Officer, but serves as an authorised escalation channel supporting POPIA governance and lawful enforcement.
